TERMS OF SERVICE

Welcome to Shop Euphoria, a subsidiary of Design Euphoria. By visiting our site and/or purchasing digital assets from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”).

1. BINDING AGREEMENT & ADHERENCE

1.1 Constructive Notice: By accessing this website and completing a purchase, you acknowledge that you have been provided with a meaningful opportunity to review these Terms.
1.2 Non-Absolution: Your failure to read, or your lack of understanding of these Terms, does not absolve you of your obligation to adhere to them. Proceeding with a purchase is an active manifestation of your assent to be legally bound by this agreement.
1.3 Ignorance is Not a Defense: Claiming ignorance of specific “Do Nots,” license restrictions, or policies will not prevent Shop Euphoria from pursuing DMCA takedowns or legal action in the event of a breach.

2. DIGITAL DELIVERY & REFUND POLICY

2.1 Final Sale: All products sold by Shop Euphoria are digital downloads. Due to the irrevocable nature of digital goods, all sales are final.
2.2 No Refunds: Once a download link has been generated or files have been accessed, we cannot offer refunds, returns, or exchanges for any reason.
2.3 No “Accidental” Purchases: The checkout process requires multiple points of intent. By completing the transaction, you acknowledge that the purchase is intentional. Claims of “accidental purchase” will not be honored once digital delivery has occurred.

3. LIMITED PERSONAL USE LICENSE

Every purchase grants you a non-exclusive, non-transferable license for Personal Use only.
Permitted Use: You may use these assets on your personal streaming channels (Twitch, YouTube, Kick, etc.) and Discord servers. You may monetize your live broadcasts (via bits, subs, and donations) while these assets are active.

4. PROHIBITED USES (“THE DO NOTS”)

You are strictly prohibited from the following. Any violation will result in an immediate revocation of your license and potential legal action:

• No Reselling: You may not sell, sub-license, or lease these digital files, whether in their original or a modified state.
• No Sharing: You may not share the files with other individuals. Each purchase is a “Single User License.”
• No Merchandise: You may not use Shop Euphoria artwork or characters (including “Cute Critters” and Waifus) for physical products (stickers, t-shirts, etc.) intended for sale.
• No Tracing/Modification: You may not edit, recolor, or “trace” our assets to redistribute or sell them as your own work.
• No AI Training: You may not use our original artwork or characters to train artificial intelligence models, machine learning algorithms, or image generators.
• No Claim of Ownership: You may not claim credit for the design or creation of the assets. Intellectual property rights remain solely with Design Euphoria.

5. INTELLECTUAL PROPERTY

All characters, designs, and OCs (Original Characters) are the exclusive intellectual property of Design Euphoria. Your purchase does not transfer copyright. Unauthorized use of our IP is a violation of international copyright law.

6. PAYMENT & THIRD-PARTY PROVIDERS

Our store is hosted on WooCommerce. We accept payments through secure third-party providers including Visa, Mastercard, Stripe, PayPal, and Apple Pay. By using these services, you also agree to their respective terms of service.

7. CHARGEBACKS & PAYMENT DISPUTES

7.1 Chargeback Prohibition: You agree that you will not initiate a chargeback or payment dispute with your bank or payment processor for any purchase made at Shop Euphoria.
7.2 Breach of Terms: Initiating a chargeback after the digital assets have been delivered is considered a fraudulent act and a material breach of these Terms.
7.3 Consequences of Disputes: In the event of a chargeback:

• Your license to use any and all Shop Euphoria assets is immediately and permanently revoked.
• Any use of the assets on platforms (Twitch, YouTube, Discord, etc.) will be subject to an immediate DMCA takedown request.
• We reserve the right to provide your IP address, download logs, and this signed agreement to the payment processor to dispute the claim.

8. LIMITATION OF LIABILITY

Shop Euphoria shall not be liable for any damages arising from the use or inability to use our products, including but not limited to channel bans or technical failures on third-party platforms.
